Royal Decree 1055/2022, packaging and packaging waste
In order to comply with Royal Decree 1055/2022, of 27 December, on packaging and packaging waste, FUCHS LUBRICANTES S.A.U. is a member of SCRAP (Extended Producer Responsibility Collective Systems) and specifically GENCI (Gestión de Envases Comerciales e Industriales), an entity that guarantees its members compliance with their EPR (Extended Producer Responsibility) obligations.
GENCI entrusts the collection and/or treatment of commercial and industrial packaging waste to authorised managers, who collect the packaging waste from the holders.
The SCRAP (GENCI) will finance all the operations carried out by the managers of this type of waste, on behalf of companies that place a product on the market using commercial and industrial packaging.
In this way, our customers will be able to maintain their agreements with their current managers (who can apply to GENCI for the corresponding financing), and in the event that they are not satisfied with the service provided, they can also contact GENCI to consult the operators authorised to ensure the correct management of commercial and industrial packaging waste.
From 1 January 2025, invoices will identify the contribution made to the GENCI SCRAP corresponding to packaging, clearly and separately from the other items included in the invoice.

Some definitions:
Producers: Companies that place a product on the market using industrial and commercial packaging. They have to finance and ensure the management of this packaging waste.
Holders: Those facilities where packaged products are consumed. They have to deliver this packaging waste to an authorised manager.
Managers: Companies that are responsible for the collection and/or treatment of industrial and commercial packaging waste.
